Welcome to The Westcoast Reader Online Learning Community. The following terms and conditions (together with any documents or additional terms, conditions or policies referred to herein or available by hyperlink) (collectively, the “Terms”) apply to your use of www.thewestcoastreader.com including any content, functionality, and services available on or through www.thewestcoastreader.com (collectively the “Site”).  The Site is operated by Decoda Literacy Solutions Society, a British Columbia not-for-profit company located at 980-1125 Howe St, Vancouver, BC Canada V6Z 2K8. Throughout the site, the terms “The Westcoast Reader”, “we”, “us”, and “our” refer to Decoda Literacy Solutions Society.

Your access to and use of the Site is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Site, including without limitation users who are browsers, users, or contributors of content.

By accessing or using the Site, you accept and agree to be bound by these Terms.  If you do not agree to all of the Terms, then you must not access or use the Site in any way.

Any new content, functionality, or services which are added to the Site will also be subject to these Terms. We may, at our discretion, update, change, add or remove any part of these Terms at any time – please check these Terms periodically for changes. Your continued use of or access to the Site following the posting of any changes to the Terms constitutes acceptance of those changes.

Personal Information

Your submission of your name, address, e-mail, telephone number, and organization through the Site is governed by our Privacy Policy.

The Content – Protected by Copyright and Trade-mark laws

The Site includes literary, musical, dramatic and artistic works, including but not limited to the design, layout, look and appearance, text, information, data, code, sounds, sound effects, sound recordings, audio, musical compositions, performances, video, cinematographic works, photographs, pictures, illustrations, and graphics (the “Content”) that is owned by or licensed to us.

All Content is protected by Canadian and international intellectual property laws and treaties, including copyright and trade-mark laws, and is owned by Decoda Literacy Solutions Society, licensed to Decoda Literacy Solutions Society or otherwise provided by a third-party. Reproduction of any of the Content is prohibited except in accordance with this Agreement.

All trade-marks (including, but not limited to, trade names, logos, word and design marks) that appear in the Site are the trademarks of Decoda Literacy Solutions Society or of their respective owners and are protected from reproduction, dilution and confusing or misleading uses. The use of any trade-mark appearing on any of the Site without the express consent of the trade-mark owner is strictly prohibited.

Use of Content

The Site may contain materials available for download, such as stories, learning resources, images or other forms of Content. You agree that downloaded materials, unless otherwise specified, are licensed to you for your personal research, scholarship, education and private study. You may not modify, redistribute, decompile, reverse engineer, disassemble the downloaded material, or use it for any commercial purpose. You must maintain all copyright or other proprietary notices. Where possible, you will provide a link to www.thewestcoastreader.com in the credit.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that we will not be responsible or liable, directly or indirectly, for any harm or damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. User-Generated Content

Users may submit articles, letters to the editor, photos, videos, discussion forums, comments and other items to the Services (“User-Generated Content”).

You are solely responsible for your User-Generated Content. You represent and warrant that you are the copyright owner of any User-Generated Content that you submit to us and that you have the unimpaired right to convey all intellectual property rights in and to the User-Generated Content to us.

You agree that your User-Generated Content will not violate any right of any third-party, including but not limited to copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your User-Generated Content will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any User-Generated Content. You are solely responsible for any User-Generated Content you make. We take no responsibility and assume no liability for any User-Generated Content submitted by you or any third-party.

You hereby grant Decoda Literacy Solutions Society a perpetual, royalty-free, irrevocable worldwide, non-exclusive licence (but not an obligation) to publish, display, retain, archive, use, store, produce, reproduce, perform in public, broadcast and communicate to the public by telecommunication, the User-Generated Content, in any material form, in whole or in part and on any platform and to sub-license such rights to other Users.

You hereby waive all moral rights in and to the User-Generated Content in favour of Decoda Literacy Solutions Society and acknowledge and agree that we may at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium, including on the Site, any User-Generated Content that you submit to us.

Disclaimer and Limitation of Liability

The Content (including any facts, views, opinions, recommendations, description of or references to products, services, links to third-party websites, licensed third-party content, and User-Generated Content) is provided to you for educational purposes only. Decoda Literacy Solutions Society does not endorse the quality, reliability, or accuracy of the Content.  The Content is not necessarily reflective of the views or policies of Decoda Literacy Solutions Society, its contributors, staff or advertisers.

Your use of the Site is at your sole risk.  The Site is provided on an “as is, where is, as available” basis.  Decoda Literacy Solutions Society and its licensors to the maximum extent permitted by law, make no warranties regarding the accuracy, timeliness, completeness or suitability of the Content and will not be responsible, or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of or in connection with your use of or reliance on the Content, including the failure of the Content to meet your needs, standard, expectations or specifications. We do not guarantee, represent or warrant that your use of our Site will be uninterrupted, timely, secure or error-free.  We may remove the Site for indefinite periods of time or take it down entirely, all without notice to you.

IN NO CASE WILL DECODA LITERACY SOLUTIONS SOCIETY, OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS AND LICENSORS, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

Indemnity

You agree to indemnify, defend and hold harmless Decoda Literacy Solutions Society, and each of our directors, officers, employees, affiliates, agents, contractors, interns, and licensors, to the greatest extent allowed by law, from and against any and all claims, damages, obligations, losses, liabilities, judgements, awards, costs or debt, and expenses (including but not limited to reasonable attorneys’ fees), resulting from or arising out of: (a) your use of and access to the Site and any material obtained from it; (b) breach of these Terms or the terms of any documents or websites they incorporate by reference; or (c) your violation of any law or the rights of any third-party.

Governing Law

These Terms and any separate agreements whereby we provide services to you will be governed by and construed in accordance with the laws of British Columbia, Canada and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. By using this website, you agree to the exclusive jurisdiction of the Courts of British Columbia and Canada within British Columbia for any claims, actions, or other legal proceedings arising from or related in any way to the Content or the Site.

Waiver and Severability

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain and continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and us and govern your use of the Site, and supersede and replace any prior agreements we might have had between us regarding the Site, including but not limited to any prior versions of these Terms.

Changes to Terms

We may, at our sole discretion, modify or replace these Terms at any time, including without limitation any information, names, text, software, images, pictures, logos, trade-marks, functionalities, or services and any other material displayed on, offered through or contained on the Site from time to time.

Your continued access to or use of our Site after any revisions will mean that you accept and agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site and should refrain from doing so.

 

Canada Post Strike in Effect. We are unable to deliver the print edition of The Westcoast Reader in time for December. We will send the newspaper when the strike is over. As a token of our appreciation, download the digital edition free of charge.
